About Membership

To become a member of our store, it is sufficient to go to our Member Transactions page and complete the relevant sections. Filling in your member details accurately and completely is very important with regard to the possibility of communication and delivery problems. Please fill them in carefully and completely so that products and services reach you quickly and reliably.

Becoming a member is a fairly simple and quick process. Becoming a member does not mean that you assume any obligation. However, please read the sales agreement carefully before shopping. You have the right to terminate your membership at any time.

Cancellation of Membership

To cancel your membership you may contact us via our contact page, at info@hali.net or through our live support lines.

Member Security

Every kind of measure has been taken in our store for the security of the member. In addition to these measures, you are also responsible for the security of your member details. Do not share the details you use to log in to our store with anyone; do not log in to the system from computers that you are not sure are secure.

Different Address

For each member there is an address section in which, when finalising an order, a different address other than their own registered address may be entered.

The address section has been designed so that you can use it when sending a gift to your friends, as well as during periods when you are at a different address. For example, you may use this section during periods when you will be at different branches of the company you work for, or during periods when you are staying at a summer house; or in cases where you want the invoice to reach you and the order to reach a friend of yours.

Product Reviews

Every member may write a review of products. The more you share your knowledge and experience with other users, the more enjoyable and informed shopping will be. Since customer reviews are impartial and based on experience, a more informed shopping environment will emerge.

Points to observe when writing a product review: within the framework of general moral rules, take care to write reviews that are respectful towards other users and towards the manufacturer of the product. Reviews are examined and reviews deemed unsuitable are deleted from the system.

Welcome to HALI.NET! The terms "we", "us" and "our" used in this text refer to Halınet Halı Tekstil Ürünleri Pazarlama Sanayi ve Ticaret A.Ş. (trading under the brand name HALI.NET). HALI.NET operates this store and website, including all related information, content, features, tools, products and services (the "Services"), in order to offer you, as a customer, a carefully curated shopping experience. HALI.NET is powered by the Shopify infrastructure, which enables us to provide the Services to you.

The following terms and conditions, together with all policies referred to herein (collectively, the "Terms of Service" or the "Terms"), explain the rights and responsibilities you have when you use the Services.

Please read these Terms of Service carefully, as they contain important information regarding your legal rights and cover areas such as disclaimers of warranty and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not accept these Terms of Service or the Privacy Policy, you must not use or access our Services.

Section 1 – Access and Account

By accepting these Terms of Service, you represent that you have reached the age of majority in your country of residence and that you give us your consent to allow the minors in your care to use the Services on devices that you own, purchase or manage.

In order to use the Services, to access or browse our online stores or to purchase any product or service we offer, you may be asked to provide certain information such as your e-mail address and billing, payment and shipping details. You represent and warrant that all information you provide in our stores is accurate, current and complete and that you have all necessary rights to provide such information.

You are solely responsible for maintaining the security of your account credentials and for all activities carried out under your account. You may not transfer, sell, assign or license your account to another person.

Section 2 – Our Products

We make every effort to represent our products and services accurately in our online stores. However, please note that colours or the appearance of a product may look different on your screen depending on the type of device you use to access the store and on its settings and configuration. In hand-woven rugs and rugs made of natural fibres, small differences in weave, pattern and colour tones result from the natural character of the product.

All descriptions relating to products may be changed at any time, entirely at our own discretion and without prior notice. We reserve the right to withdraw any product from sale at any time and we may limit the quantities of the products we offer for a particular person, geographical region or country, as the case may be. This provision does not remove our liability for defects arising from consumer legislation or our obligation for the product to conform to the contract.

Section 3 – Orders

When you place an order, you make an offer to purchase. HALI.NET reserves the right to accept your order or to reject it on justified grounds. Your order is not deemed accepted until acceptance is confirmed by HALI.NET. For your order to be accepted, your payment must be received and processed by us. Please check your order carefully before submitting it. In the event that the order is not accepted, is amended or is cancelled, we will attempt to contact you via the e-mail address, billing address and/or telephone number you provided when placing the order. If the order is not accepted or is cancelled, any amount collected is refunded without delay.

The products you purchase are subject to return or exchange in accordance with our Return and Refund Policy. In purchases you make in the capacity of a consumer, you have the right to withdraw within 14 days of the date on which you received the product, without giving any reason and without paying any penalty. Products manufactured to order for a specific person or place, or cut to a custom size, fall outside the scope of the right of withdrawal by their nature. Exercising the right of withdrawal does not affect your statutory rights relating to defective products.

You represent that the products you purchase are for your personal or household use and not for commercial resale or export.

Section 4 – Prices and Billing

Prices, discounts and campaigns may be changed without prior notice. The price to be charged for a product or service is the price in effect on the date the order is placed and is stated in your order confirmation e-mail. Unless expressly stated otherwise, announced prices do not include taxes, shipping, handling, customs or import charges. In sales to consumers, the total amount payable is clearly shown at the basket and checkout steps before payment.

The prices published in our online stores may differ from the prices offered in physical stores or in other sales channels operated by third parties. From time to time we may offer promotions in our Services that may affect prices and that are subject to terms and conditions separate from these Terms. In the event of a conflict between the terms of a promotion and these Terms, the terms of the promotion prevail.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases you make in our stores. You agree to keep your account and other information, including your e-mail address, card numbers and expiry dates, up to date so that we can complete your transactions and contact you when necessary.

You represent and warrant that: (i) the payment card information you provide is accurate and complete, (ii) you are authorised to use that card for the purchase transaction, (iii) the charges made by you will be honoured by your card issuer, and (iv) you will pay all charges arising at the published prices, including shipping and handling fees and all applicable taxes, if any.

Section 5 – Shipping and Delivery

Your orders are dispatched within 10 days at the latest following confirmation of payment. The estimated delivery time is 3-7 business days for standard products and 7-14 business days for custom-size/custom-cut products. Shipping within Türkiye is free of charge. All delivery times are estimates; we are not responsible for delays arising from the shipping company, customs procedures or events beyond our control. Risk of damage and loss in consumer sales. If you are shopping in the capacity of a consumer, the risk of loss of or damage to the product passes to you at the moment the product is actually (physically) delivered to you or to a third party designated by you. As long as we designate the shipping company, delivery of the product to the carrier does not pass the risk to you. If you have designated the carrier yourself, outside the options offered by us, and have notified us of this, the risk passes to you upon delivery of the product to that carrier.

Risk of damage and loss in commercial (B2B) sales. In sales made for commercial or professional purposes, where the buyer is not a consumer, ownership and the risk of loss/damage pass to the buyer at the moment the products are delivered to the shipping company.

If you believe that the product has been delivered damaged or incomplete, having the courier draw up a report at the time of delivery speeds up the process; however, not having had a report drawn up does not remove the statutory rights you have in the capacity of a consumer.

Section 6 – Intellectual Property

Our Services, including but not limited to all trademarks, brands, texts, visuals, images, graphics, product reviews, video and audio content, together with their design, selection and arrangement, are the property of HALI.NET, its business partners or its licensors and are protected by Turkish legislation, in particular the Turkish Law on Intellectual and Artistic Works No. 5846 and the Turkish Industrial Property Law No. 6769, and by the international conventions to which Türkiye is a party.

These Terms permit you to use the Services solely for your personal and non-commercial use. You may not reproduce, distribute, modify, adapt, create derivative works from, publicly display or perform, republish, download, store or transmit any of the materials in the Services without our prior written consent. Except as expressly stated herein, no provision may be construed as granting you a licence or any other right under any patent, trademark, copyright or other intellectual property right belonging to HALI.NET, Shopify or any third party. Unauthorised use of the Services may constitute an infringement of the provisions of the FSEK and the SMK and may give rise to civil and criminal liability. All rights not expressly granted herein are reserved by HALI.NET.

The name, logo, product and service names, designs and slogans of HALI.NET are trademarks of HALI.NET or of its business partner or licensor. You may not use these marks without the prior written consent of HALI.NET. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans appearing in the Services are the trademarks of their respective owners.

Section 7 – Optional Tools

As part of the Services, you may gain access to tools offered by third parties that are not monitored, controlled or managed by us.

You acknowledge that we provide access to these tools "as is" and "as available", without any warranty, representation or condition and without giving any endorsement. Our liability arising from the use of optional third-party tools is limited to the extent permitted by applicable legislation.

Your use of the optional tools offered on the site is at your own discretion; you must make sure that you are aware of and agree to the terms of use provided by the relevant third-party provider(s).

In the future we may provide new features (including new tools and resources) through the Services. Such new features will also be considered part of the Services and will be subject to these Terms of Service.

Section 8 – Third-Party Links

The Services may contain materials and links (including embedded third-party functionality) belonging to websites provided or operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party material or website you choose to access. If you decide to leave our Services and access these materials or third-party websites, you do so at your own risk.

To the extent permitted by applicable legislation, we are not liable for damages arising from your access to any third-party website or from your purchase or use of products, services, resources or content on those sites. Please review the third party's policies and practices carefully. Complaints, claims or questions concerning third-party products and services must be directed to the third party.

Section 9 – Relationship with Shopify

HALI.NET is powered by the Shopify infrastructure, which enables us to provide the Services to you. However, every sale and purchase transaction you carry out in our store is made directly with HALI.NET. By using the Services, you acknowledge that Shopify is not a party to the sale between you and HALI.NET and that the obligations arising from that sale belong to HALI.NET. This provision does not in any way limit the statutory rights you have against the seller (HALI.NET) in the capacity of a consumer.

Section 10 – Privacy Policy

All personal data we collect through the Services is subject to our Privacy Policy; in addition, certain personal data may be subject to the Shopify Privacy Policy, which can be viewed here. By using the Services you acknowledge that you have read our Privacy Policy.

Because the Services are hosted on the Shopify infrastructure, Shopify processes your personal data relating to your access to and use of the Services for the purpose of providing and improving the Services for you. The data you submit to the Services may be transferred to Shopify and to third parties which may be located in countries other than your country of residence, for the purpose of providing the service to you. For details on how your personal data is processed by us, by Shopify and by our business partners, and on your rights under the Turkish Personal Data Protection Law No. 6698 and the related legislation, please review our Privacy Policy.

Section 11 – Feedback

If you send, upload, share or otherwise transmit any idea, suggestion, feedback, review, proposal, plan or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable and royalty-free licence to use, reproduce, adapt, publish, distribute and perform such Feedback in all media and for all purposes, including commercial use. We may use our rights under this licence to operate, provide, evaluate, develop and promote the Services and to fulfil our obligations under the Terms of Service.

You further represent and warrant that: (i) you own or have all necessary rights in all Feedback; (ii) you have disclosed any consideration or incentive you have received in connection with your submission of Feedback; and (iii) your Feedback complies with these Terms. We have no obligation to keep your Feedback confidential, to pay any consideration for your Feedback or to respond to your Feedback.

At our own discretion, we may monitor, edit or remove Feedback that we determine to be unlawful, offensive, threatening, insulting or defamatory, pornographic, obscene or otherwise objectionable, or to infringe any party's intellectual property rights or these Terms of Service.

You agree that your feedback will not infringe copyright, trademark, privacy, personality rights or other personal or proprietary rights. You further agree that your feedback will not contain computer viruses or other malicious software that could affect the operation of the Services or of any related website. You may not use a false e-mail address, impersonate anyone other than yourself, or mislead us or third parties as to the origin of any feedback. You are responsible for the content and accuracy of the feedback you provide.

Section 12 – Errors, Inaccuracies and Omissions

From time to time there may be typographical errors, inaccuracies or omissions in the Services relating to product descriptions, prices, promotions, offers, shipping charges, transit times and stock availability. In the event that any information is incorrect, we reserve the right to correct errors, update information or cancel an order without prior notice (even after you have submitted your order). In the event that an order is cancelled because of a manifest material error, the full amount collected is refunded without delay.

Section 13 – Prohibited Uses

You may access and use the Services only for lawful purposes. You may not access or use the Services, directly or indirectly, for the following purposes:

for any unlawful or malicious purpose;
to violate any international, national or local legislation, rule or regulation;
to infringe our intellectual property rights or those of others;
to harass, abuse, insult, defame, disparage, intimidate or harm our employees or any other person;
to transmit false or misleading information;
to send, knowingly receive, upload, download, use or re-use any material that does not comply with these Terms;
to transmit, or procure the sending of, advertising or promotional material, including unsolicited e-mail, chain letters, spam or similar solicitations;
to impersonate or attempt to impersonate another person or entity;
to engage in any other conduct that restricts or inhibits the use of the Services by others or that may harm HALI.NET, Shopify or users of the Service.

You further agree not to do the following:

to upload or transmit viruses or other types of malicious code that will affect the functionality or operation of the Services;
to reproduce, copy, extract, sell, resell or exploit any part of the Services;
to collect or track the personal data of others;
to use the Services for spam, phishing, a fraudulent website or deception;
to use robots, spiders, scraping, data harvesting and extraction tools, automated devices or processes, or autonomous artificial intelligence tools to access the Services;
to interfere with, circumvent or defeat the security or authorisation features, robot exclusion headers or other measures we use to restrict access to the Services.

If we determine that you have breached any part of these Terms, we reserve the right to suspend, disable or terminate your account. If you are acting in the capacity of a consumer, this measure will be notified to you together with its reasons and will not affect the rights arising from your completed orders.

Section 14 – Agents (Autonomous Software)

14.1. This section (the "Agent Terms") applies if you use, permit, enable or cause to be deployed an Agent in order to access, use or interact with any Service. "Agent" means any software or service that performs autonomous or semi-autonomous actions on behalf of, or at the instruction of, any person or entity and that may be run using or on behalf of a person's device without direct supervision.

14.2. No Agent may access, use or interact with the Services unless it identifies itself at all times and operates in strict compliance with the requirements set out in Article 14.4 below. Furthermore, if we request that an Agent not access the Services, that Agent may not access, use or interact with the Services.

14.3. We may limit, including by technical measures, how and in what manner any Agent may access the Services, use the Services and interact with the Services.

14.4. Agents must:

indicate in all HTTP/HTTPS requests that the request comes from an Agent and clearly declare the name of the Agent by using the format "Agent/<agent name>" in the user-agent string of the request;
not conceal or obscure that any access, use or interaction comes from an Agent, for example by imitating human behaviour and interaction patterns or by completing or circumventing measures such as CAPTCHA that are intended to distinguish computer use from humans;
respond accurately to any question or request intended to determine whether interactions come from a human or from a computer;
not circumvent or otherwise defeat any measure intended to prevent, limit, alter or control Agents' access to, use of or interaction with the Services.

Section 15 – Termination

We may terminate this agreement or your access to the Services (or any part thereof) where justified grounds exist; you remain responsible for the debts that have accrued up to the date of termination. Termination does not affect your consumer rights in relation to your completed orders.

The following sections continue to apply after termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law and Competent Court, Privacy Policy, and other provisions which by their nature must continue to apply after termination.

Section 16 – Disclaimer of Warranties

General information provided on or through the Services is for information purposes only. We give no warranty as to the accuracy, completeness or usefulness of this information; any action you take in reliance on it is at your own risk.

Unless expressly stated otherwise by us, the Services and all products offered through the Services are provided "as is" and "as available", without any express or implied representation, warranty or condition. This includes implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement. We do not undertake that your use of the Services will be uninterrupted, timely, secure or error-free.

Limitation for consumers. The disclaimer provisions in this section apply only to the maximum extent permitted by applicable consumer legislation. If you are shopping in the capacity of a consumer, all your rights arising from mandatory law are reserved, including our obligation for the product to conform to the contract and to its description and your statutory rights of choice arising from a defective product (free repair, replacement with a defect-free equivalent, price reduction or rescission of the contract). This section may not limit, reduce or remove those rights. Statutorily mandatory warranty/conformity periods apply in any event.

Section 17 – Limitation of Liability

To the fullest extent permitted by applicable legislation, Halınet Halı Tekstil Ürünleri Pazarlama Sanayi ve Ticaret A.Ş., our business partners, directors, employees, affiliates, representatives, contractors, service providers or licensors shall not be held liable, whether based on contract, tort, strict liability or any other legal ground, for indirect, incidental, special or punitive damages (including loss of profit, loss of revenue, loss of savings, loss of data or replacement costs) arising from your use of the Services or from any product obtained through the Services.

Limitation for consumers. The limitations of liability in this section apply only to the maximum extent permitted by applicable consumer legislation and do not affect your rights arising from mandatory law. In no case are the following liabilities of ours limited or excluded: (a) liability arising from death or personal injury; (b) liability arising from intent or gross negligence; (c) statutory liability arising from a defective product and product liability; (d) other liabilities that cannot be limited under applicable legislation. In the capacity of a consumer, your rights are reserved in respect of damages that are the foreseeable and direct consequence of a breach of contract.

Section 18 – Indemnification

You agree to indemnify and hold harmless Halınet Halı Tekstil Ürünleri Pazarlama Sanayi ve Ticaret A.Ş., Shopify and their affiliates, business partners, directors, employees, representatives, contractors, licensors and service providers against any loss, damage, liability or claim payable to third parties (including reasonable attorneys' fees) arising from (1) your breach of these Terms of Service or of the documents incorporated by reference, (2) your violation of any law or of the rights of a third party, or (3) your access to and use of the Services.

We will notify you of any claim covered by the indemnity; a delay in notification does not remove your obligations unless you have suffered material prejudice. We may conduct the defence and settlement of such claims, including the choice of counsel; however, we will not accept any settlement that imposes a non-monetary obligation on you without your consent, which will not be unreasonably withheld. You agree to cooperate in the defence by providing the relevant documents.

This section applies only in respect of claims arising from your own fault and, if you are acting in the capacity of a consumer, applies to the extent permitted by mandatory consumer legislation.

Section 19 – Severability

In the event that any provision of these Terms of Service is determined by a competent court to be unlawful, void or unenforceable, that provision shall continue to be enforceable to the fullest extent permitted by applicable legislation and the unenforceable part shall be deemed severed from these Terms of Service. This does not affect the validity and enforceability of the remaining provisions.

Section 20 – Waiver; Entire Agreement

Our failure to exercise or enforce any right or provision set out in these Terms of Service does not mean that we waive that right or provision.

These Terms of Service and all policies published on the site constitute the entire agreement between you and us in relation to your use of the Services and supersede all prior or contemporaneous oral or written agreements, notices and proposals (including previous versions of the Terms of Service).

Any ambiguities that may arise in the interpretation of these Terms of Service may not be construed against the consumer; ambiguous provisions are construed against the party that drafted the terms (HALI.NET).

Section 21 – Assignment

You may not assign or transfer this agreement or any of your rights and obligations under these Terms without our prior written consent; any attempt to do so is void. We may transfer these Terms and our rights and obligations hereunder to a third party, provided that this does not produce a more unfavourable outcome for you and that you are given reasonable prior notice.

Section 22 – Governing Law and Competent Court

These Terms of Service and any separate agreements relating to the provision of the Services to you by us are governed by and construed in accordance with Turkish law. The Istanbul (Anatolian) Courts and Enforcement Offices shall have jurisdiction over disputes arising out of or in connection with these Terms.

Rights reserved for consumers. If you are shopping in the capacity of a consumer, the above choice of law does not remove your right to benefit from the mandatory consumer protection provisions of the law of your habitual residence (the country in which you ordinarily live). The protection afforded to you by those provisions is reserved in any event.

Consumers residing in Türkiye may apply, depending on the monetary value of the dispute, to the Consumer Arbitration Committees or to the Consumer Courts. The application may be made to the arbitration committee or the court at the consumer's place of residence or at the place where the transaction was carried out. Consumers residing in the European Union have the right to bring proceedings before the competent courts of their own country and the right to use national alternative dispute resolution mechanisms.

Section 23 – Headings

The headings used in this agreement are included for convenience only; they do not limit or otherwise affect these Terms.

Section 24 – Changes to the Terms of Service

You may review the most current version of the Terms of Service on this page at any time.

We reserve the right to update, change or replace any part of these Terms of Service by publishing updates and changes on our website. We will notify you of material changes to these Terms in accordance with the applicable legislation and those changes take effect on the date stated in the notice. Your continued use of the Services following the publication of the changes means that you accept those changes. The changes made do not apply to orders you placed before the change; the Terms in force on the date of each order apply to that order.
